New Build or Fixer-Upper in Forsyth County: What Actually Decides It

Septic sequencing, lot slope and drainage, erosion triggers and Forsyth County's 50 percent substantial-improvement rule shape the buy-and-renovate versus build-new decision more than purchase price does.

Buy an older house in an established Forsyth County neighborhood and renovate it, or build new on a lot? Most articles answer this with national averages and a tidy spreadsheet. In Cumming and North Atlanta the decision is usually settled by less romantic things: whether the property is on septic or sewer, how the lot sheds water, whether any of it sits in a floodplain, and how much of the house you intend to touch.

Here is what actually moves the answer locally.

Start with directional cost, not a national average

Before comparing paths, get a realistic sense of what each one costs in this market. Our North Atlanta Custom Build Index publishes directional 2026 planning ranges for custom homes, kitchens, primary baths and additions across Cumming, Alpharetta, Milton, Suwanee and Forsyth County, along with typical timelines. Those are planning tools, not quotes, and they are the right starting point — a national per-square-foot figure will mislead you in either direction here.

One structural point from the Index worth carrying into this decision: additions cost more per square foot than new construction, because they have to tie into an existing structure — matching rooflines, reworking HVAC, connecting to existing plumbing and electrical. Renovation is not automatically the cheaper path per foot. It is the path that buys you location and mature lots.

Septic or sewer decides your sequence

This is the single most consequential question about any Forsyth County property, and it applies to both paths.

The Forsyth County Environmental Health Land Use Section issues on-site sewage management permits, and its rule is explicit: "If you plan to build or remodel a home or if you want to put a building or pool on your property that is served by a septic system you will have to get approval from the environmental health department before you can obtain a building permit." It also cautions that "it may take twenty business days or more to process an application or review."

So on a septic property, the approval sequence runs Environmental Health first, building permit second — for a remodel as much as for new construction. There is a dedicated Remodel or Addition Application for the renovation case. County permit packets list "Environmental Health Approval — Required if on septic" as a required attachment.

A new dwelling on public sewer takes a different route: proof of sewer purchase and proof of water meter purchase, or a Well Affidavit. The county also notes that "Impact Fees are required on all new residential dwellings" — a cost that attaches to building new and not to renovating an existing house.

Ask about septic before you ask about anything else. It shapes what can be added, where, and how long the front end of the project takes.

The lot: slope and drainage, not soil heave

You will read that Georgia red clay swells and heaves foundations. For the soils typical of this region, that is not what the record says. The USDA-NRCS official description for the Cecil series — the archetypal Piedmont red clay — rates shrink-swell potential as low and drainage as well drained, with saturated hydraulic conductivity of roughly 0.6 to 2.0 inches per hour in the clay subsoil.

The real local variables are different, and they are worth understanding:

  • Slope. The Georgia Piedmont runs from gently rolling, around 2 to 10 percent, to rather steep slopes of 25 to 45 percent and beyond. Slope drives grading, retaining walls and foundation design. It is also what makes a walkout terrace level possible on some lots and not others.
  • Surface water. Clay subsoil with only moderate infiltration means water moves across the ground rather than soaking straight in. Grading, downspout routing, footing drains and driveway drainage matter more here than soil chemistry does.
  • What the footing bears on. Two centuries of agriculture stripped much of the topsoil from mid- and upper-slope positions across the Piedmont, exposing clayey subsoil. That is exactly why Forsyth County's footing inspection covers "depth, bearing strength of soil, any reinforcement required."

For a fixer-upper, walk the lot in the rain before you buy. For a new build, expect the site work line to vary more between two lots than between two floor plans.

Retaining walls follow a bright line in the county's permit guide: walls over 6 feet, measured from the bottom of the footing to the top of the wall, require a permit; walls 6 feet or less do not.

Erosion rules can attach to either path

Georgia's Erosion and Sedimentation Act exempts projects disturbing less than one acre — but that exemption does not apply within a larger common plan of development of an acre or more, "or within 200 feet of the bank of any state waters." Georgia separately establishes a 25-foot buffer along the banks of all state waters. Even where an exemption applies, anyone responsible for land disturbance "must prevent sediment from moving beyond the boundaries of the property."

Forsyth County's permit forms ask for total disturbed acreage at application, and state that where the disturbed acreage requires an individual lot permit, a Georgia Erosion and Sediment Control Certification Card is required at the time of permit. A creek at the back of an otherwise attractive lot is not a dealbreaker — it is a design constraint you want priced before closing, not after.

The floodplain rule that catches renovations

This one is directly aimed at the fixer-upper decision and almost nobody raises it early enough.

Under Forsyth County's flood damage prevention ordinance, no owner or developer may perform development activities on a site where a Special Flood Hazard Area is located without first meeting the article's requirements. For new construction and substantial improvements, the lowest floor including basement must be elevated "no lower than three (3) feet above the base flood elevation or one (1) foot above the future-conditions flood elevation, whichever is higher." That is stricter than the federal minimum. Elevation certificates are required.

The definition that does the work is "substantial improvement": "any combination of repairs, reconstruction, alteration, or improvements to a structure, taking place during the life of a structure, in which the cumulative cost equals or exceeds 50 percent of the market value of the structure."

Read that twice if you are considering a heavy renovation of an older house near water. A gut renovation whose cumulative cost crosses 50 percent of the structure's market value can pull the whole house into the elevation standard. And the definition is cumulative over the life of the structure, so previous work counts. On a floodplain lot, that single rule can make building new the cheaper and simpler route — or make a lighter-touch renovation the sensible scope.

Older houses carry two regulated conditions

If the house predates 1978, lead-safe work practices are regulated, and Georgia runs its own program rather than deferring to the EPA. Georgia EPD administers the Lead-Based Paint Hazard Management Rules, under which a certified Renovator "must be working for a certified Renovation Firm when performing a renovation project," with Georgia-approved training and exam. The correct terms here are Georgia-certified Renovator and Georgia-certified Renovation Firm.

Asbestos is governed by Georgia EPD's asbestos rules. Any project "involving ten (10) or more continuous linear feet or ten (10) or more square feet of asbestos-containing material requires a project notification and fees paid," on a ten-working-day notification period before work starts. Legal owners of residences of four or fewer dwelling units are exempt from demolition notification requirements unless the work is part of a larger project — an exemption that does not extend to the renovation threshold above, and does not exempt anyone from handling the material safely.

Neither of these makes an older house a bad buy. They are line items that belong in the comparison rather than surfacing in week three.

Weather sets the schedule, and it favors interior work

Rain, not cold, is the scheduling constraint in this part of Georgia. NOAA's 1991–2020 normals for Gainesville, the nearest long-record station to Cumming, show 53.16 inches of annual precipitation and 81.3 days a year with at least a tenth of an inch of rain — with no dry season at all. Every month's normal falls between 3.69 and 5.23 inches, and the wettest quarter is January through March.

Snow is negligible at 1.9 inches a year, and the freeze-free season runs about 234 days, with a median last spring freeze around March 27. There are roughly 51 nights a year at or below freezing but only about 1.8 days a year when the temperature never rises above it.

The practical consequence: excavation, footings and site work — the front end of a new build — are the most weather-exposed part of any project, and they are most likely to slip in exactly the months that are wettest. A renovation that is largely interior is less exposed to that. Neither fact decides the question, but both belong in a realistic schedule.

One check that applies either way

Georgia law requires a current, valid residential or general contractor license for residential contracting. If a contract for licensed work is signed with someone who does not hold one, it "shall be unenforceable in law or in equity by the unlicensed contractor," and "no lien or bond claim shall exist in favor of the unlicensed contractor." Forsyth County checks it at the permit counter: pulling an addition or new dwelling permit requires a notarized form with the state license and a current business license attached.
